1. Acceptance of Terms

These Terms and Conditions govern the supply and use of all goods and services provided by Actuel PC Pty Ltd ACN 696403415 ABN 14696403415, trading as Actuel PC.

By using our website, purchasing goods or services, joining a membership, purchasing a one-month pass, entering a promotion, or otherwise dealing with Actuel PC, you agree to these Terms and Conditions.

Actuel PC may update these Terms from time to time. Updates take effect when published on the website.

2. Privacy

Actuel PC handles personal information in accordance with the Privacy Act 1988 (Cth) and our Privacy Policy.

We may collect and use personal information to process orders, manage accounts, manage memberships, apply discounts, allocate promotional entries, verify eligibility, conduct draws, contact winners, fulfil prizes, prevent fraud, provide support, and comply with legal obligations.

3. Goods and Services

Actuel PC operates as a Queensland-based online retailer and membership store selling PC components, gaming hardware, custom and prebuilt PCs, cyber apparel, desk mats, accessories, digital content, member discounts, and related gaming products.

Memberships provide access to tier-based benefits, which may include store discounts, member emails, event invites, early access, VIP perks, community updates, offers, and free promotional entries.

From time to time, Actuel PC may run promotional live draws, giveaways, competitions, prize draws, or other promotional activities to promote our goods, services, memberships, brand, and customer community. These are referred to as Promotions.

Promotional entries are provided as a free promotional benefit attached to an eligible membership, one-month pass, purchase, offer, free-entry method, or other approved method stated in the relevant Promotion terms.

Membership and pass fees are charged for the membership benefits attached to the selected tier. They are not payments for lottery tickets, gambling products, raffle tickets, or paid entries. Entries have no cash value, cannot be purchased separately, cannot be sold or transferred, and do not guarantee any prize or outcome.

4. Monthly Memberships

Monthly memberships renew automatically each month unless cancelled.

Each successful monthly payment or renewal may allocate free promotional entries according to the member’s active tier. Entries stack month to month while the member maintains an uninterrupted active membership, up to a maximum of 60 entries.

Once a member reaches 60 entries, no further stacked entries are added. The member must continue to maintain an active paid membership to keep those entries active and remain eligible for current and future Promotions.

Tier 1 — Wanderer

Includes 1 free promotional entry per month, stacking up to 60 entries, 5% off eligible store products, Wanderer fortnightly email, Wanderer event invites, and cancel anytime.

Tier 2 — Hero

$24.95/month
Includes 3 free promotional entries per month, stacking up to 60 entries, 10% off eligible store products, Hero fortnightly email, Hero event invites, and cancel anytime.

Tier 3 — Guardian

$39.95/month
Includes 5 free promotional entries per month, stacking up to 60 entries, 15% off eligible store products, Guardian fortnightly email, Guardian event invites, and cancel anytime.

Tier 4 — VIP Mythic

$69.99/month
Includes 10 free promotional entries per month, stacking up to 60 entries, 25% off eligible store products, Mythic fortnightly email, Mythic event invites, VIP perks, priority access, and cancel anytime.

5. Entry Stacking

Entry stacking occurs on the date the member first subscribes and on each successful monthly renewal date.

For example, if a Tier 2 Hero member subscribes on 12 May, they receive 3 free promotional entries. If their payment successfully renews on 12 June, they receive another 3 entries and will then hold 6 total entries, subject to the 60-entry cap and any Promotion-specific rules.

Monthly memberships renew on the same calendar date each month where possible. If that date does not exist in a future month, renewal may occur on the closest available billing date.

Entries are only active while the membership remains active and in good standing. If a membership is cancelled, unpaid, suspended, charged back, terminated, or otherwise inactive, the member’s entries may be removed and the member may lose eligibility for active draws.

6. One-Month No-Lock-In Passes

Actuel PC may offer one-month no-lock-in membership passes.

One-month passes are paid once, do not auto-renew, and expire after 30 days unless otherwise stated. They provide access to the relevant tier benefits for the 30-day period, including free promotional entries where applicable. One-month passes do not include stacked entries.

If one or more Promotions occur during the active 30-day pass period, the pass holder may be entered into those Promotions according to the relevant pass tier and Promotion terms.

Wanderer One-Month Pass — $11.49 once-off
Includes 1 free promotional entry for the month, 5% off eligible store products, Wanderer fortnightly email, Wanderer event invites, no subscription, and no auto-renew.

Hero One-Month Pass — $28.99 once-off
Includes 3 free promotional entries for the month, 10% off eligible store products, Hero fortnightly email, Hero event invites, no subscription, and no auto-renew.

Guardian One-Month Pass — $45.99 once-off
Includes 5 free promotional entries for the month, 15% off eligible store products, Guardian fortnightly email, Guardian event invites, no subscription, and no auto-renew.

VIP Mythic One-Month Pass — $80.99 once-off
Includes 10 free promotional entries for the month, 25% off eligible store products, Mythic fortnightly email, Mythic event invites, VIP perks, priority access, no subscription, and no auto-renew.

Once the pass expires, all pass benefits, discounts, access, and entries end unless the member purchases another pass or starts an active monthly membership.

7. Cancellations, Upgrades and Downgrades

Members may cancel their membership at any time through the member portal or any other cancellation method made available by Actuel PC.

Once a member cancels, their stacked entries are removed from the draw system and they are no longer eligible for active or future Promotions, unless otherwise stated in the Promotion terms or required by law.

No refund is provided for cancellation during an active membership period, except where required by law.

If a member upgrades to a higher-priced tier, they may keep their accumulated stacked entries and begin receiving the higher tier’s monthly entry allocation from the next applicable billing or renewal period.

If a member downgrades to a lower-priced tier, their accumulated stacked entries are removed and their entry stack restarts under the lower tier.

Actuel PC may adjust, suspend, remove, or reset entries due to billing issues, chargebacks, suspected fraud, duplicate accounts, system errors, misuse, or breach of these Terms.

8. Store Discounts and Member Emails

Membership discounts apply only to eligible store products during the active membership or pass period.

Discounts may be applied by coupon code, account-based discount, member login, or any other method used by Actuel PC.

Discounts may exclude limited-release products, already discounted items, shipping, Printful products, third-party fulfilled products, giveaway prizes, custom builds, special orders, or any other excluded product stated on the website.

Discounts cannot be exchanged for cash, transferred, combined with other offers unless approved, or used after the membership or pass expires.

Members may receive tier-based emails, offers, event invites, community news, promotional updates, and account-related messages. Members may unsubscribe from marketing emails where required by law, but transactional or account-related emails may still be sent where necessary.

9. Promotion Eligibility

Unless otherwise stated for a specific Promotion, entry is open only to eligible Australian residents who are at least 18 years of age.

Actuel PC may exclude residents of certain states or territories where permit, authority, legal, or operational requirements make the Promotion unavailable.

Employees, contractors, directors, officers, agents, immediate family members of Actuel PC, and anyone involved in conducting a Promotion may be excluded.

Actuel PC may require proof of identity, age, address, membership status, payment status, and eligibility before confirming a winner or awarding a prize.

10. Draws and Winner Selection

Actuel PC may set a deadline date and time for each Promotion. Only valid entries recorded before the deadline will be included.

Unless otherwise stated, Actuel PC will aim to complete the draw within 72 hours after the entry deadline.

Promotions may have one winner, or first, second, and third-place winners, depending on the specific Promotion terms.

Winners will be selected by random draw from all valid eligible entries. Draws may be conducted live, by recorded process, approved random selection software, manual draw, or another fair method stated in the Promotion terms.

Actuel PC may disqualify any participant who tampers with the entry process, provides false information, breaches these Terms, acts fraudulently, uses duplicate accounts, abuses the system, or compromises the fairness of a Promotion.

If a winner cannot be contacted, does not respond, is ineligible, refuses the prize, or fails verification, Actuel PC may conduct a redraw or deal with the prize as permitted by law and the Promotion terms.

By entering a Promotion, participants consent to publication of their name, suburb, state, image, likeness, social media handle, or winner details where required by law or Promotion terms.

11. Accounts and Website Use

Customers and members must provide accurate and current information, including name, address, date of birth, phone number, email address, and payment details where required.

Members are responsible for keeping their account login details secure and must notify Actuel PC of any suspected unauthorised access.

Actuel PC may suspend, restrict, or terminate any account, membership, entry allocation, discount, or website access where it reasonably suspects fraud, misuse, payment issues, unlawful conduct, breach of these Terms, or conduct affecting the fairness of a Promotion.

Customers and members must not misuse the website, submit false information, abuse staff, infringe intellectual property rights, interfere with systems, or attempt to manipulate memberships, discounts, entries, or Promotions.

12. Consumer Rights and Returns

Nothing in these Terms limits, excludes, or modifies any rights that cannot lawfully be excluded under the Australian Consumer Law.

For minor faults, Actuel PC may provide a repair, replacement, refund, or other remedy as permitted by law.

For major faults, customers may be entitled to a refund, replacement, or compensation in accordance with the Australian Consumer Law.

No refunds or returns are available for change of mind, incorrect size selection, buyer’s remorse, or cancellation of an active membership period, except where required by law or expressly approved by Actuel PC.

13. Product Warranty

For prebuilt PCs purchased directly from Actuel PC, warranty support applies to verified manufacturing defects, component faults, and assembly issues in accordance with the Australian Consumer Law, applicable manufacturer warranties, and any warranty terms published at the time of purchase.

Warranty support does not apply to damage or faults caused by misuse, neglect, physical damage, liquid damage, electrical surge, improper use, unauthorised modification, customer-installed parts, software issues, viruses, malware, unsafe overclocking, poor maintenance, third-party repairs, or any issue not caused by a manufacturing, component, or assembly defect.

Customers may need to provide proof of purchase, photos, videos, fault details, diagnostic information, and reasonable cooperation.

If no covered fault is found, or the issue is caused by an excluded reason, the customer may be responsible for inspection, labour, repair, replacement, shipping, and return costs.

14. Printful and Third-Party Products

Some apparel, desk mats, accessories, and printed products may be produced, fulfilled, and shipped by third-party suppliers, including Printful.

Because these products may be made-to-order, change-of-mind returns, size changes, colour changes, buyer’s remorse, or incorrect customer selections may not be accepted unless required by law or approved by Actuel PC.

If a third-party fulfilled product arrives damaged, misprinted, defective, incorrect, or affected by a fulfilment issue, the customer must contact Actuel PC with photos, order details, and a description of the issue so it can be assessed.

Nothing in this section limits any rights under the Australian Consumer Law.

15. Prizes and Prize Warranty

Prizes are supplied as promotional prizes and are not sold to the winner.

Unless stated in the specific Promotion terms, Actuel PC does not provide a separate paid product warranty on prize items. However, any manufacturer warranty or non-excludable rights that apply by law are not excluded.

Where a prize is a custom-built or prebuilt PC assembled by Actuel PC, Actuel PC may provide a prize-specific warranty only if stated in the relevant Promotion terms.

Prize support may be refused where the issue is caused by misuse, neglect, physical damage, modification, software misuse, viruses, malware, unsafe overclocking, liquid damage, electrical damage, transport damage after delivery, or any cause not linked to a manufacturing or assembly defect.

Actuel PC may substitute a prize where the advertised prize is unavailable, discontinued, delayed, or impractical to supply, provided the substitute is of similar type and equal or greater value where required by law.

16. Changes to Law, Promotions or Business Model

Actuel PC may amend, suspend, cancel, replace, redraw, restrict, or modify any Promotion, entry method, membership benefit, tier structure, entry allocation, entry cap, or draw process where required for legal, regulatory, permit, platform, supplier, payment provider, operational, or business reasons.

If any law, regulation, regulator position, or proposed reform affects membership-based promotional entries, Actuel PC may alter the Promotion structure, introduce an alternative entry method, restrict locations, change eligibility, reduce or remove promotional entries, or replace promotional entries with other member benefits.

Membership fees continue to apply to the remaining membership benefits unless the member cancels or unless otherwise required by law.

17. Liability

To the maximum extent permitted by law, Actuel PC and its officers, employees, contractors, and agents exclude liability for any direct, indirect, special, or consequential loss arising from the supply of goods or services, use of the website, operation of memberships, or conduct of any Promotion.

This includes technical issues, third-party interference, unauthorised access, communication delays, payment issues, fulfilment delays, lost or damaged prizes, incorrect details supplied by participants, prize use, tax liability, or events beyond Actuel PC’s reasonable control.

Where an event beyond Actuel PC’s reasonable control affects a Promotion, Actuel PC may vary, cancel, suspend, redraw, or reschedule the Promotion or affected part, subject to applicable law.

Pokémon tier is a test tier for the website it will not have a draw date and will run for the duration of the website test if anyone enters you will be awarded the prize of 1x Pokémon foil for your belief in my test and company. 

18. General

If any part of these Terms is invalid or unenforceable, the remaining parts continue to apply.

Failure by Actuel PC to enforce a right does not waive that right.

These Terms are governed by the laws of Queensland, Australia.

The parties submit to the non-exclusive jurisdiction of the courts and tribunals of Queensland, Australia.
